What a BOC-3 is and who files it

What it does

Form BOC-3 designates process agents — people or companies authorised to receive court papers for you in each state where you operate. The point is that a carrier based in one state can be served in another without anyone having to track you down.

The FMCSA will not grant interstate operating authority without a BOC-3 on file, and will suspend authority that already exists if the designation lapses. That makes it less a piece of paperwork than a precondition.

Why you cannot file it yourself

A carrier cannot designate itself. The filing has to be submitted by a process agent or a blanket agent company that maintains coverage in the states concerned — which is why every BOC-3 you see advertised is sold by an agent rather than filed direct.

The only exception is a carrier that operates in a single state and maintains its own agent there. For anything interstate, blanket coverage through an agent is the practical route.

How often you file it

Once, normally. Unlike UCR, a BOC-3 does not expire annually. It stays on your record until it is replaced by a new designation or cancelled by the agent who filed it.

That last part matters. Some agents charge an ongoing fee and cancel the designation if it goes unpaid — at which point the FMCSA sees a carrier with no active process agent and can suspend the authority. If your authority is suspended and the reason mentions a process agent, this is what happened.

What to check

• That the designation covers all 50 states, not a subset.
• Whether the price is one-time or annual, and what happens if an annual fee lapses.
• That it appears on your FMCSA record after filing — the record is the evidence, not the invoice.
